Railways and Transport Safety Act 2003 Explanatory Notes

Territorial Extent

9.This Act extends to the whole of the United Kingdom, with the following exceptions:

Scotland

10.The Act extends to Scotland except:

  • Part 1 (Investigation of Railway Accidents) in so far as it applies to tramways

  • Part 3 (British Transport Police) in so far as it applies to tramways

  • Section 28 (Exercise of powers by civilians)

  • Section 86 (Shipping: right of entry)

  • Section 98 (Aviation: right of entry)

  • Section 109 (Road traffic: fixed penalty)

  • Section 111 (Highways: snow and ice)

Northern Ireland

11.The Act extends to Northern Ireland except:

  • Part 2 (Office of Rail Regulation)

  • Part 3 (British Transport Police)

  • Section 104 (Office of Rail Regulation: general duties)

  • Section 105 (Railways safety levy)

  • Section 106 (Railway security services)

  • Section 107 and Schedule 7 (Road Traffic: testing for drink and drugs)

  • Section 108 (Traffic regulation on long distance routes)

  • Section 109 (Road traffic: fixed penalty)

  • Section 110 (Seat belts: delivery drivers)

  • Section 111 (Highways: snow and ice)

  • Section 114 (Railways in London: transfers)

  • Section 115 (Railways in London: information)

Territorial application: Wales

12.This Act does not affect any of the National Assembly of Wales’s powers. However, section 111 will impose a duty on the National Assembly to remove snow and ice from those highways for which it has responsibility.
