SCHEDULE 4Taking of fingerprints or non-intimate samples

4Consent to taking of evidence

The necessary identification evidence may be taken—

a

with the appropriate consent given in writing, or

b

without that consent, in accordance with paragraph 5.

In sub-paragraph (1) “the appropriate consent” has the meaning given by section 65 of the Police and Criminal Evidence Act 1984 or, in Northern Ireland, Article 53 of the Police and Criminal Evidence (Northern Ireland) Order 1989.

The court shall inform the person concerned of the effect of this paragraph.
