68 Appeals to the Tribunal.E+W

(1)An appeal against a decision of [F1the Welsh Council] under this Part in respect of registration shall lie to the Tribunal.

[F2(1A)An appeal shall lie to the Tribunal against a decision of [F1the Welsh Council] under Part 3 of the General Systems Regulations in respect of an aptitude test, or period of adaptation, in connection with a person's becoming permitted, by virtue of that Part of those Regulations, to have access to, and to pursue, the profession of social worker in the United Kingdom.]

[F3(1B)An appeal shall lie to the Tribunal against a decision of the Welsh Council under Part 3 of the General Systems Regulations in respect of an aptitude test, or period of adaptation, in connection with a person becoming permitted, by virtue of that Part of those Regulations, to have access to, and to pursue, the profession of social care manager in the United Kingdom.

(1C)An appeal shall lie to the Tribunal against a decision of the Welsh Council under regulation 67 of the General Systems Regulations to send an alert about a person.]

(2)On an appeal against a decision, the Tribunal may confirm the decision or direct that it shall not have effect [F4or, in the case of an appeal under subsection (1C), direct that the alert be withdrawn or amended] .

(3)The Tribunal shall also have power on an appeal against a decision—

(a)to vary any condition for the time being in force in respect of the person to whom the appeal relates;

(b)to direct that any such condition shall cease to have effect; or

(c)to direct that any such condition as it thinks fit shall have effect in respect of that person.

69 Publication etc. of register.E+W

(1)[F5The Welsh Council] shall publish the register maintained by it in such manner, and at such times, as it considers appropriate.

(2)Any person who asks the Council for a copy of, or of an extract from, the register shall be entitled to have one.

71 Rules.E+W

(1)Any power of [F7the Welsh Council] to make rules under this Part may be exercised—

(a)either in relation to all cases to which the power extends, or in relation to all those cases subject to specified exceptions, or in relation to any specified cases or classes of case; and

(b)so as to make, as respects the cases in relation to which it is exercised, the same provision for all cases in relation to which the power is exercised, or different provision for different cases or different classes of case, or different provision as respects the same case or class of case for different purposes.

(2)Rules made by [F7the Welsh Council] under this Part may make provision for the payment of reasonable fees to the Council in connection with the discharge of the Council’s functions [F8, but subject to subsection (3A)].

(3)In particular, the rules may make provision for the payment of such fees in connection with—

(a)registration (including applications for registration or for amendment of the register [F9, but subject to subsection (3A)]);

(b)the approval of courses under section 63;

(c)the provision of training;

(d)the provision of copies of codes of practice or copies of, or extracts from, the register,

including provision requiring persons registered under this Part to pay a periodic fee to the Council of such amount, and at such time, as the rules may specify.

[F10(3A)Rules made by [F11the Welsh Council] under this Part may not make provision for the payment of fees in connection with registration in the visiting [F12European social worker part or visiting European social care manager part] of the register.]

(4)No rules shall be made by [F13the Welsh Council] under this Part without the consent of the appropriate Minister.
