LEA report on performance of head teacher

Where the authority have any serious concerns about the performance of the head teacher of the school—
a
they shall make a written report of their concerns to the chairman of the governing body at the same time sending a copy to the head teacher; and
b
the chairman of the governing body shall notify the authority in writing of the action which he proposes to take in the light of the report.

In determining whether to make a report under this paragraph the authority shall have regard to any guidance given from time to time by the Secretary of State.
