In section 69 of the Medicines Act 1968 (general provisions as to when a person is lawfully conducting a retail pharmacy business)—

a

in subsection (1), after “Subject to” there is inserted “subsection (1A) below and”, and

b

after subsection (1) there is inserted—

1A

A person carrying on a retail pharmacy business shall not be taken to be a person lawfully conducting such a business if—

a

(in any case) the business is under the personal control of a pharmacist who is subject to a suspension order or an interim suspension order, or

b

(in the case of a body corporate) the business is under the management of a superintendent who is subject to such an order.

1B

For the purposes of subsection (1A) of this section—

a

a person is subject to an order during the period for which the order has effect, and

b

“suspension order” and “interim suspension order” have the same meaning as in the [1954 c. 61.] Pharmacy Act 1954.
