Functions of Secretary of State E+W

[F1 42A Procedure in relation to [F2 exercise of powers under section 42 ] E+W

(1) The Secretary of State may by regulations make provision as to the procedure to be followed in the exercise of any power conferred or duty imposed by section F3 ... 42.

(2) Before making any regulations under this section, the Secretary of State shall consult with—

[F4 (a) the Mayor's Office for Policing and Crime;]

(b) [F5 the National Police Chiefs' Council]; and

(c) such other persons as he thinks fit.

(3) Regulations under this section may make different provision for different cases and circumstances.

(4) A statutory instrument containing regulations under this section shall be subject to annulment in pursuance of a resolution of either House of Parliament.]
