Appeals

1

An appeal against a decision of the Secretary of State under Part VII shall lie to a Registered Homes Tribunal.

An appeal shall be brought by notice in writing given to the Secretary of State.

No appeal may be brought by a person more than 28 days after service on him of notice of the decision.

On an appeal, the Tribunal may confirm the Secretary of State’s decision or direct that it shall not have effect.

A Tribunal shall also have power on an appeal to—

a

vary any condition for the time being in force by virtue of Part VII with respect to the home to which the appeal relates;

b

direct that any such condition shall cease to have effect; or

c

direct that any such condition as it thinks fit shall have effect with respect to the home.
