1E+W+SNothing in section 3 of this Act shall render unlawful any act done by any person if—
(a)it was done before the commencement of that section, or
(b)it was done before the commencement of section 9(3) of this Act and it was necessary for him to do it in order to comply with section 124(1) of the M1Mines and Quarries Act 1954.
