This Part applies to premises which consist of or include a dwelling and are not held under a tenancy to which Part II of the M1Landlord and Tenant Act 1954 applies.

But this Part does not apply if the dwelling is in Wales and is subject to an occupation contract (see section 7 of the Renting Homes (Wales) Act 2016 (anaw 1)).

In this Part “service charge” has the meaning given by section 18(1) of the 1985 Act.
