24 Regulation of conduct of drivers, inspectors and conductors.E+W+S

(1)Regulations may make provision for regulating the conduct, when acting as such, of—

(a)[F1persons licensed to act as] drivers of public service vehicles, and

(b)inspectors and conductors of such vehicles.

(2)Subject to section 68(1) of this Act, if a person to whom regulations having effect by virtue of this section apply contravenes, or fails to comply with, any of the provisions of the regulations, he shall be liable on summary conviction to a fine not exceeding [F2level 2 on the standard scale] and, in the case of an offence by a person acting as driver, the court by which he is convicted may, if it thinks fit, cause particulars of the conviction to be endorsed upon [F3the counterpart of] the licence granted to that person under [F4section 22 of this Act][F4Part III of the Road Traffic Act 1988].

(3)The person who has the custody of the licence [F5and its counterpart] shall, if so required by the convicting court, produce [F6the licence][F6them] within a reasonable time for the purpose of endorsement, and, subject to section 68(1) of this Act, if he fails to do so, shall be liable on summary conviction to a fine not exceeding [F7level 3 on the standard scale].

(4)In this section and in section 25 of this Act “inspector”, in relation to a public service vehicle, means a person authorised to act as an inspector by the holder of the PSV operator’s licence under which the vehicle is being used.

[F8(5)Notwithstanding section 1(1) of this Act, in this section and in sections 25 and 26 of this Act “public service vehicle” shall be construed as meaning a public service vehicle being used on a road for carrying passengers for hire or reward.]
