SCHEDULE 10 Rent Assessment Committees

The Welsh Ministers shall draw up and from time to time revise a panel of persons to act as chairmen and other members of rent assessment committees in Wales.

The panel shall consist of a number of persons appointed by the Lord Chancellor and a number of persons appointed by the Welsh Ministers.

No appointment of a person to F19the panel by the Lord Chancellor shall be such as to extend beyond the day on which the person attains the age of F2475.

The F20Welsh Ministers shall nominate one of the persons appointed by the Lord Chancellor to act as president of the panel, and one or more such persons to act as vice-president or vice-presidents.

Subject to this Schedule, the number of rent assessment committees F11in Wales and the constitution of those committees shall be determined by the president of the panel F12... or, in the case of the president’s absence or incapacity, by the vice-president or, as the case may be, one of the vice-presidents.

Subject to F2F21paragraphs 5A, 6 and 6A below, each rent assessment committee shall consist of a chairman and one or two other members, and the chairman shall be either the president or vice-president (or, as the case may be, one of the vice-presidents) of the panel or one of the other members appointed by the Lord Chancellor.

A member of the First-tier Tribunal may, at the request of the president or vice-president of the panel and with the approval of the Senior President of Tribunals, act as a member of a rent assessment committee in Wales.

F235B

A member of a tribunal listed in section 59 of the Wales Act 2017 (the Welsh tribunals) who is not a member of a rent assessment committee in Wales may, at the request of the president or vice-president of the panel and with the approval of the President of Welsh Tribunals, act as a member of such a committee.

The president of the panel may, if he thinks fit, direct that when dealing with such cases or dealing with a case in such circumstances as may be specified in the direction, the chairman sitting alone may, with the consent of the parties, exercise the functions of a rent assessment committee.

When dealing with an application under section 81A of this Act a rent assessment committee carrying out the functions of a rent tribunal shall consist of the chairman of the committee sitting alone.

There shall be paid to members F13of the panel such remuneration and allowances as the F14Welsh Ministers , F4. . ., may determine.

F57A

The F17Welsh Ministers may, F6. . ., provide for the payment of pensions, allowances or gratuities to or in respect of any person nominated to act as president or vice-president of F18the panel .

The President of the panel may appoint, with the approval of the F22Welsh Ministers as to numbers, such clerks and other officers and servants of rent assessment committees as he thinks fit, and there shall be paid to the clerks and other officers and servants such salaries and allowances as the F22Welsh Ministers , F7. . ., may determine.

There shall be paid out of moneys provided by Parliament—

a

the remuneration and allowances of members of F15the panel ;

b

the salaries and allowances of clerks and other officers and servants appointed under this Schedule; and

c

F16such other expenses of the panel as the Welsh Ministers may determine .
