35 Application to Scotland.S
In the application of this Part of this Act in Scotland—
(a)“the court” means the sheriff, and any application to the sheriff under this Part of this Act shall be disposed of in a summary manner; and
(b)“mortgagee” means creditor in a heritable security, and “heritable security” has the same meaning as in the M1Conveyancing (Scotland) Act 1924 except that it includes a security constituted by ex facie absolute disposition or assignation.
