Section 47AB (2) of the Terrorism Act 2000 (“the Act”) requires the Secretary of State to issue a code of practice in connection with the exercise of the stop and search powers referred to in section 47AA of the Act. The Secretary of State has decided to issue one code for England, Wales and Scotland and a separate code for Northern Ireland. This Order brings those codes of practice into force.
The code of practice for England, Wales and Scotland may be downloaded from the Home Office website. The code of practice for Northern Ireland may be downloaded from the Northern Ireland Office website.
Draft Explanatory Memorandum sets out a brief statement of the purpose of a Draft Statutory Instrument and provides information about its policy objective and policy implications. They aim to make the Draft Statutory Instrument accessible to readers who are not legally qualified accompany any Statutory Instrument or Draft Statutory Instrument laid before Parliament from June 2004 onwards.
