4. In paragraph 3(1) (list of establishments)—
(a)for “(10)” substitute “(9C)”, and
(b)after paragraph (a) insert—
“(aa)a school falling within section 19(2) or (2B) of the Education Act 1996(1) (pupil referral units etc) which does not fall within sub-paragraph (1)(a);”.
