The Order is made in exercise of the powers conferred on the Secretary of State by section 3(3) of the Terrorism Act 2000(1).

The Secretary of State believes that the organisation to be added to Schedule 2 to that Act by article 2 of this Order is concerned in terrorism.

In accordance with section 123(4)(a) of that Act, a draft of this Order was laid before Parliament and approved by a resolution of each House of Parliament.

Accordingly, the Secretary of State makes the following Order—

Citation and commencement

1.  This Order may be cited as the Terrorism Act 2000 (Proscribed Organisations) (Amendment) (No. 2) Order 2008 and shall come into force on the day after the day on which it is made.

Proscribed organisations

2.  In Schedule 2 (Proscribed Organisations) to the Terrorism Act 2000(2), for “Hizballah External Security Organisation” substitute “The military wing of Hizballah, including the Jihad Council and all units reporting to it (including the Hizballah External Security Organisation).”.

EXPLANATORY NOTE

(This note is not part of the Order)

Part 2 of the Terrorism Act 2000 makes provision about proscribed organisations (including setting out offences in relation to such organisations in sections 11 to 13). An organisation is proscribed if it is listed in Schedule 2 to that Act or operates under the same name as an organisation so listed (section 3(1)). Article 2 to this Order adds an organisation to the list in that Schedule in substitution for an existing organisation so listed.
