The Consumers, Estate Agents and Redress Act 2007 (Commencement No. 3 and Supplementary Provision) Order 2008

The Secretary of State makes the following Order in exercise of the powers conferred by sections 63(2) and (3) and 66(2) of the Consumers, Estate Agents and Redress Act 20071.

In accordance with section 62(3)(h) of that Act, a draft of this instrument has been laid before Parliament and approved by resolution of each House of Parliament.

Citation1

This Order may be cited as the Consumers, Estate Agents and Redress Act 2007 (Commencement No. 3 and Supplementary Provision) Order 2008.

Interpretation2

In this Order “the Act” means the Consumers, Estate Agents and Redress Act 2007.

Commencement3

Section 5 (forward work programme) of the Act shall come into force on 7th May 2008.

Supplementary provision4

For the purposes of section 5 of the Act, paragraph (a) of the definition of “financial year” in section 41(1) of the Act has effect as if it referred to the period beginning with 1st October 2008 and ending with 31st March 2010.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into force section 5 of the Consumers, Estate Agents and Redress Act 2007 which requires the National Consumer Council to produce a forward work programme before each financial year. Article 4 modifies the definition of financial year as it applies in relation to section 5 so that the first financial year of the Council will be the period which begins on 1st October 2008 and ends on 31st March 2010.

The remaining provisions of the Consumers, Estate Agents and Redress Act 2007 will be brought into force by subsequent Orders.
