Terrorism Act 2000 (Continuance of Part VII) Order 2004

Coming into force

Whereas a draft of this Order has been laid before Parliament under section 123(4)(f) of the Terrorism Act 20001, and approved by resolution of each House of Parliament;

Now, therefore, in exercise of the powers conferred by section 112(2)(a) and (b) of the Terrorism Act 2000, the Secretary of State hereby makes the following Order:

This Order may be cited as the Terrorism Act 2000 (Continuance of Part VII) Order 2004 and shall come into force on 19th February 2004.

Subject to paragraph (2), the provisions of Part VII of the Terrorism Act 2000 which are in force on 18th February 20042 shall continue in force for the period beginning with 19th February 2004 and ending with 18th February 2005.

Section 97(3) of the Terrorism Act 2000 shall cease to have effect.

This Order continues in force for a further period of twelve months the provisions of Part VII of the Terrorism Act 2000 (which extend to Northern Ireland only) with the exception of the following provisions:

a

section 100, which has not been brought into force;

b

section 76, which ceased to have effect by virtue of the Terrorism Act 2000 (Cessation of Effect of Section 76) Order 2002 (S.I.2002/2141);

c

section 97(1) and (2), which ceased to have effect by virtue of the Terrorism Act 2000 (Continuance of Part VII) Order 2003 (S.I.2003/427);

d

section 97(3), which shall cease to have effect on 19th February 2004;

e

paragraph 36 of Schedule 4, which ceased to have effect by virtue of the Terrorism Act 2000 (Continuance of Part VII) Order 2003 (S.I.2003/427);

f

paragraph 19 to 21 of Schedule 5, which ceased to have effect by virtue of the Terrorism Act 2000 (Continuance of Part VII) Order 2003 (S.I.2003/427).

The provisions continued in force by this Order will continue in force up to and including 18th February 2005.
