The Police Act 1997 (Offences in Schedules 8A and 8B) Amendment (Scotland) Regulations 2022

The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 126ZB(1) of the Police Act 1997(1) and all other powers enabling them to do so.

In accordance with section 126ZB(2) of that Act, a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament.

Citation and commencement

1.  These Regulations may be cited as the Police Act 1997 (Offences in Schedules 8A and 8B) Amendment (Scotland) Regulations 2022 and come into force on 19 December 2022.

Modification of schedule 8A of the Police Act 1997

2.—(1) Schedule 8A of the Police Act 1997 (offences which must be disclosed unless a sheriff orders otherwise)(2) is modified as follows.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Police Act 1997 (“the 1997 Act”).

Regulation 2 makes amendments to schedule 8A of the 1997 Act to update the list of offences which must be disclosed on a criminal record certificate, or an enhanced criminal record certificate, issued under the 1997 Act unless a sheriff orders otherwise.

Regulation 3 makes amendments to schedule 8B of the 1997 Act to update the list of offences which are to be disclosed on a criminal record certificate, or enhanced criminal record certificate, subject to rules in the 1997 Act.
