The Scottish Ministers make the following Regulations in exercise of the power conferred by paragraph 1(1) of schedule 19 of the Coronavirus Act 2020(1) (“the Act”) and all other powers enabling them to do so.

These Regulations are made in response to the serious and imminent threat to public health which is posed by the incidence and spread of coronavirus in Scotland.

The Scottish Ministers consider that the restrictions and requirements imposed by these Regulations are proportionate to what they seek to achieve, which is a public health response to that threat.

In accordance with paragraph 6(2) and (3) of schedule 19 of the Act, the Scottish Ministers are of the opinion that, by reason of urgency, it is necessary to make these Regulations without a draft having been laid before, and approved by, a resolution of the Scottish Parliament.

PART 1Introduction

Citation, commencement and application

1.—(1) These Regulations may be cited as the Health Protection (Coronavirus, Restrictions) (Aberdeen City) Amendment Regulations 2020 and come into force on 24 August 2020.

(2) These Regulations apply in Scotland.

Amendment of the Health Protection (Coronavirus, Restrictions) (Aberdeen City) Regulations 2020

2.—(1) The Health Protection (Coronavirus, Restrictions) (Aberdeen City) Regulations 2020(2) are amended in accordance with paragraphs (2) to (7).

(2) In regulation 5 (requirement to close premises and businesses), after paragraph (1), insert—

(1A) Paragraph (1) does not prevent a business taking preparatory steps, while the premises remain closed to members of the public, in pursuance of the requirement in regulation 4(1) of the Health Protection (Coronavirus) (Restrictions) (Scotland) Regulations 2020(3) (requirement to take measures to minimise risk of exposure to coronavirus)..

(3) After regulation 5, insert—

Requirement to close premises and businesses: casinos

5A.(1) A person responsible for carrying on a casino business in the protected area must not carry on that business in the protected area.

(2) Paragraph (1) does not prevent a business taking preparatory steps, while the premises remain closed to members of the public, in pursuance of the requirement in regulation 4(1) of the Health Protection (Coronavirus) (Restrictions) (Scotland) Regulations 2020 (requirement to take measures to minimise risk of exposure to coronavirus).

(3) If a business described in paragraph (1) (“business A”) forms part of a larger business (“business B”), the person responsible for carrying on business B complies with the requirement in paragraph (1) if it closes down business A..

(4) In regulation 6 (enforcement of requirements)—

(a)in paragraph (3)(b), delete “subject to paragraph (4),”,

(b)omit paragraph (4).

(5) In regulation 7(1) (offences and penalties), after “5” insert “or 5A”.

(6) In the schedule (businesses subject to restrictions or closure), after paragraph 4, insert—

5.  Bingo halls.

6.  Bowling alleys or amusement arcades.

7.  Funfairs (whether outdoors or indoors).

8.  Outdoor theatres..

(7) In regulation 9(1) (expiry), after “expire” until the end substitute, “at midnight on Tuesday 25 August.”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Health Protection (Coronavirus, Restrictions) (Aberdeen City) Regulations 2020.

They extend the types of businesses selling food or drink for consumption on the premises in the local authority area of Aberdeen City which are required to close, to include entertainment and leisure businesses like bingo halls, bowling alleys and amusement arcades. They also require casinos in the local authority area of Aberdeen City to remain closed. Businesses listed in the schedule are required to close, subject to limited exceptions.

The Health Protection (Coronavirus, Restrictions) (Aberdeen City) Regulations 2020 will expire at midnight on Tuesday 25 August.

No impact assessment has been prepared for these Regulations.
