Benefits not assignable on bankruptcy

19.—(1) On the bankruptcy or sequestration of a person entitled to benefit under these Regulations, no part of the benefit is to be paid to any trustee or other person acting on behalf of creditors, except as provided by paragraph (2).

(2) Where, following the bankruptcy or sequestration of any person entitled to benefit under these Regulations, a person makes or varies a debtor contribution order under section 90 or 95 of the Bankruptcy (Scotland) Act 2016(1) or the court makes an income payments order under section 310 of the Insolvency Act 1986(2) that requires the Scottish Ministers to pay all or part of the benefit to the person’s trustee in bankruptcy, the Scottish Ministers must comply with that order.
