The Scottish Ministers make the following Order in exercise of the powers conferred by section 88(6) of the Marine (Scotland) Act 2010(1) and all other powers enabling them to do so.

In accordance with section 88(7) of that Act, the Scottish Ministers intend to make a marine conservation order (a “permanent order”) in respect of the Loch Carron MPA(2) (in accordance with the requirements of section 87 of that Act), and they have published notice of their proposal to make the permanent order(3).

Citation and commencement

1.  This Order may be cited as the Loch Carron Urgent Marine Conservation (No. 2) Order 2017 (Urgent Continuation) Order 2018 and comes into force on 19th May 2018.

Continuation of the Loch Carron Urgent Marine Conservation (No. 2) Order 2017 and duration in force

2.  The Loch Carron Urgent Marine Conservation (No. 2) Order 2017(4) is to remain in force for the period of 364 days beyond that specified in article 1(2) of that Order.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order is an “urgent continuation order” which provides that the Loch Carron Urgent Marine Conservation (No. 2) Order 2017 (“the 2017 Order”), an “urgent marine conservation order”, remains in force for the period of 364 days beyond the period which is specified in article 1(2) of the 2017 Order. The 2017 Order would otherwise remain in force until the end of 19th May 2018.

The Loch Carron MPA was designated by the Loch Carron Nature Conservation Marine Protected Area (No. 2) Order 2017 (“the MPA Order”). The MPA Order is available at www.gov.scot/Resource/0052/00520992.pdf . Within the MPA Order, the conservation objectives are stated in article 5 and the protected features are stated in schedule 2, as introduced by article 4.
