The Scottish Ministers make the following Scheme in exercise of the powers conferred by sections 15(1) and (2), 18(1), 18A and 31(1), (3), (5) and (9) of the Fisheries Act 1981(1) and all other powers enabling them to do so.
In accordance with sections 15(3) and 31(6)(2) of that Act, a draft of this instrument has been laid before, and approved by resolution of, the Scottish Parliament.
1981 c.29. Section 15 was amended by S.I. 1999/1820, schedule 2, Part I, paragraph 68(2) and modified by the Fisheries Act 1981, section 18A (which was inserted by S.I. 1999/1820, schedule 2, Part I, paragraph 68(4) and amended by S.I. 2000/2040, schedule 1, Part I, paragraph 10(2) and Part III). Section 18(1) has also been modified by section 18A of the 1981 Act. Section 31 was amended by S.I. 1999/1820, schedule 2, Part I, paragraph 68(6) and Part IV, paragraph 1; and by S.I. 2000/2040, schedule 1, Part I, paragraph 10(3) and Part III.
Sections 15(3) and 31(6) have been modified by the Interpretation and Legislative Reform (Scotland) Act 2010 (asp 10), schedule 3, paragraph 6.
