The Scottish Ministers make the following Regulations in exercise of the power conferred by section 1(7) of the Public Bodies (Joint Working) (Scotland) Act 2014(1) and all other powers enabling them to do so.

In accordance with section 69(2) of that Act, a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament.

Citation and commencement

1.  These Regulations may be cited as the Public Bodies (Joint Working) (Prescribed Local Authority Functions etc.) (Scotland) Amendment Regulations 2017 and come into force on 16th June 2017.

Amendment of the Public Bodies (Joint Working) (Prescribed Local Authority Functions etc.) (Scotland) Regulations 2014

2.—(1) The Public Bodies (Joint Working) (Prescribed Local Authority Functions etc.) (Scotland) Regulations 2014(2) are amended as follows.

(2) In Part I of the schedule (functions prescribed for the purposes of section 1(7) of the Public Bodies (Joint Working) (Scotland) Act 2014), after the entry relating to section 19 of the Social Care (Self-directed Support) (Scotland) Act 2013(3), in Column A insert—

Carers (Scotland) Act 2016(4)
Section 21
(duty to set local eligibility criteria).

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Public Bodies (Joint Working) (Prescribed Local Authority Functions etc.) (Scotland) Regulations 2014 to add section 21 of the Carers (Scotland) Act 2016 to Part I of the schedule of those Regulations. The functions under section 21 are therefore prescribed for the purpose of section 1(7) of the Public Bodies (Joint Working) (Scotland) Act 2014. The effect of this is that functions under section 21 are functions which must be delegated to the bodies responsible for providing integrated health and social care services in local authority areas. These bodies are known as integration joint boards.

Section 21 was inserted into the schedule of the Public Bodies (Joint Working) (Scotland) Act 2014 by paragraph 6 of the schedule of the Carers (Scotland) Act 2016 (asp 9).
