1.—(1) These Regulations may be cited as the National Health Service Pension Scheme (Scotland) Amendment Regulations 2016.
(2) These Regulations come into force on 1st April 2016 and have effect from 1st April 2015.
2. The National Health Service Pension Scheme (Scotland) Regulations 2015(1) are amended as follows.
3. In regulation 27 (pensionable earnings)—
(a)in paragraph (1), for the Table substitute—

4. In regulation 30 (members’ contributions: employees)—
(a)in paragraph (3)—
(i)for the words from “M’s contribution rate” to “earnings fall.”, substitute—
“M’s contribution rate—
for the scheme year 2015/16 is the percentage specified in column 2 of Table 1 below in respect of the corresponding pensionable earnings band specified in column 1 into which M’s pensionable earnings fall; and
for the scheme year 2016/17 is the percentage specified in column 2 of Table 2 below in respect of the corresponding pensionable earnings band specified in column 1 into which M’s pensionable earnings fall.”;
(ii)for “Table: Scheme Year 2015/16”, substitute “Table 1”; and
(iii)at the end, insert—

5. In regulation 31 (members’ contributions: practitioners and non-GP providers)—
(a)for paragraph (3), substitute—
“(3) M’s contribution rate—
(a)for the scheme year 2015/16 is the percentage specified in column 2 of Table 1 in paragraph (9) in respect of the corresponding pensionable earnings band specified in column 1 into which M’s pensionable earnings fall; and
(b)for the scheme year 2016/17 is the percentage specified in column 2 of Table 2 in paragraph (9) in respect of the corresponding pensionable earnings band specified in column 1 into which M’s pensionable earnings fall.”;
(b)in paragraph (4), omit “specified in the Table”;
(c)in paragraph (5), for “medical practitioner” substitute “provider”;
(d)in paragraph (9)—
(i)for “The Table”, substitute “The Tables are”;

6. In regulation 32(6) (contributions by employing authorities), in column 1 of the table for “ophthalmic medical practitioner” substitute “ophthalmic provider”.
7. In regulation 37(9)(b) (members contributions: supplementary), for “manger” substitute “manager”.
8. In regulation 43(2)(b)(ii) (making and varying a buy-out election), for “manger” substitute “manager”.
9. In regulation 112(2) (surviving adult dependant pension), for “of” substitute “or”.
10. In regulation 152(2)(b) (medical practitioner), for “(5)” substitute “(6)”.
11. In paragraph 1 of Schedule 1 (Pension Board), at the end insert—
“(3) The scheme manager must be satisfied that a person to be appointed as a member of the Board does not have a conflict of interest.”.
12. In paragraph 16 of Schedule 3 (administrative matters)—
(a)in sub-paragraph (5)(a), omit “in accordance with paragraph 17”;
(b)in sub-paragraph (6), for “lime” substitute “time”;
(c)in sub-paragraph (9), for “2013 Act” substitute “Finance Act 2013”; and
(d)in sub-paragraph (10), for “change” substitute “charge”.
13. In Schedule 5 (membership gateways)—
(a)in Part 2 (medical contractors), in paragraph 3(b), for “practice” substitute “contractor”; and
(b)in Part 3 (medical practitioners and dental practitioners)—
(i)in paragraph 4(a), after “practitioner” insert “(construed in accordance with regulation 152)”; and
(ii)in paragraph 4(b), omit “medical”.
14. In Schedule 7 (pension accounts)—
(a)in paragraph 15, for “regulation 44(6)” substitute “regulation 44(4)”; and
(b)in paragraph 25(1)(b), for “ceases to be payable” substitute “is abated to zero under”.
15. In Schedule 9 (determination of pensionable earnings: setting contribution rates)—
(a)in paragraph 2(2), after “column 2 of the” insert “applicable”;
(b)in paragraph 3—
(i)in sub-paragraph (1), for “the table” substitute “Table 2”; and
