The Scottish Ministers make the following Regulations in exercise of the powers conferred by sections 9(3) to (6), 10, 17, 23(2), 25(2), 26(2), 28(1), 41D(5), 41I, 66(3) and 82 of the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997(1) and all other powers enabling them to do so.
1997 c.9. The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c.46). Section 9 was amended by section 7(3) of the Planning etc. (Scotland) Act 2006 (asp 17) and paragraph 9 of schedule 3 to the Historic Environment Scotland Act 2014 (asp 19). Sections 41D and 41I are inserted by section 23(1) of the Historic Environment (Amendment) (Scotland) Act 2011 (asp 3). Section 41I applies section 41D(5).
