Appeals made before the commencement date65

This regulation applies in respect of—
a
an appeal under section 19 of the principal Act; and
b
an appeal against a hazardous substances contravention notice,
where notice of the appeal is given before the commencement date.

The 1993 Regulations continue to apply to an appeal to which this regulation applies as those Regulations had effect immediately before the commencement date.

Regulation 38 (notice of decision on appeal) applies in respect of an appeal to which this regulation applies.
