SCHEDULE 2 Relevant Offences for the Purposes of Section 35 (fines: court to consider financial benefits)

The Waste Management Licensing (Scotland) Regulations 2011

21.  An offence under any of the following provisions of the Waste Management Licensing (Scotland) Regulations 2011(1)—

(a) regulation 19(1) (carrying on an exempt activity without registration)(2);

(b) regulation 28(6) (carrying on an exempt activity in breach of the registration obligations);

(c) regulation 30(1) (unregistered broker or dealer etc.)(3);

(d) paragraph 12(1) of Schedule 4 (unregistered collecting or transporting of waste);

(e) paragraph 14(4), (6) or (7) of Schedule 4 (record keeping).
