REHABILITATION OF OFFENDERS
This Order consolidates the Rehabilitation of Offenders Act 1974 (Exclusions and Exceptions) (Scotland) Order 2003 (“2003 Order”) which excludes and makes exceptions to the provisions of section 4 (effect of rehabilitation) of the Rehabilitation of Offenders Act 1974 (“the Act”). It excludes further proceedings and types of work from certain provisions within that section and updates the terms used to reflect recent legislation, including the Legal Services (Scotland) Act 2010 and the Electronic Money Regulations 2011.

Exclusion of section 4(1) of the Act3
The application of section 4(1) of the Act is excluded in relation to—
a
any proceedings specified in Schedule 1; and
b
any proceedings with respect to a decision or a proposed decision specified in Part 1 of Schedule 2—
i
to the extent that there falls to be determined in those proceedings any issue relating to a spent conviction or to circumstances ancillary thereto; and
ii
to the extent that section 4(1) renders inadmissible any evidence relating to the conviction or circumstances or removes the requirement to answer any question relating to the conviction or circumstances.
