The Animal Health (Miscellaneous Amendments) (Scotland) Order 2013

The Scottish Ministers make the following Order in exercise of the powers conferred by section 2(2) of the European Communities Act 1972 M1 and sections 1, 8(1), 8A, 15(3), (4) and (5), 17(1), 23, 35(3) and 83(2) of the Animal Health Act 1981 M2, and all other powers enabling them to do so M3.

Section 2(2) was amended by the Scotland Act 1998 (c.46) (“the 1998 Act”), Schedule 8, paragraph 15(3) (which was amended by section 27(4) of the Legislative and Regulatory Reform Act 2006 (c.51) (“the 2006 Act”)). Section 2(2) was also amended by section 27(1) of the 2006 Act and by the European Union (Amendment) Act 2008 (c.7), Schedule, Part 1. The functions conferred upon the Minister of the Crown under section 2(2) of the 1972 Act, insofar as within devolved competence, were transferred to the Scottish Ministers by virtue of section 53 of the 1998 Act. The powers in section 2(2) are exercised in relation to articles 12, 18 and 20 of this Order.

M21981 c.22 (“the 1981 Act”). Section 8 was amended by paragraph 1 of schedule 2 to the Animal Health and Welfare (Scotland) Act 2006 (asp 11). Powers to make Orders under these sections were originally conferred on “the Ministers” (as defined in section 86(1) of the 1981 Act). The functions of the Ministers were, insofar as within devolved competence, transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998.

M3The powers to make this Order are exercised together by virtue of section 33(2) of the Interpretation and Legislative Reform (Scotland) Act 2010 (asp 10). The Order is subject to the negative procedure by virtue of section 33(4) of that Act.

Citation, commencement and extentS

1.—(1) This Order may be cited as the Animal Health (Miscellaneous Amendments) (Scotland) Order 2013 and comes into force on 28th June 2013.

(2) This Order extends to Scotland only.

The Export of Horses (Veterinary Examination) Order 1966S

2.—(1) The Export of Horses (Veterinary Examination) Order 1966 M4 is amended in accordance with this article.

(2) In article 2(1) (interpretation), for the definition of “Divisional Veterinary Manager” substitute—

authorised veterinary inspector” means a veterinary inspector authorised by the Scottish Ministers to receive notification about the shipment of horses from ports and aerodromes;.

(3) In article 3 (notice requesting veterinary examination for horses to be exported), for “the Divisional Veterinary Manager” substitute “ an authorised veterinary inspector ”.

3.—(1) The Rabies (Control) Order 1974 M5 is amended in accordance with this article.

(2) In article 2(1) (interpretation)—

(a)omit the definition of “Divisional Veterinary Manager”; and

4.—(1) The Importation of Animals Order 1977 M6 is amended in accordance with this article.

5.—(1) The Warble Fly (Scotland) Order 1982 M7 is amended in accordance with this article.

Explanatory Note

(This note is not part of the Order)

This Order amends specified Orders and Regulations to remove definitions of, and references to, “Divisional Veterinary Manager”, and replaces them with definitions of, and references to, “authorised veterinary inspector”.

Further amendments remove references to the Ministry of Agriculture, Fisheries and Food, and clarify that references to the Chief Veterinary Officer refer to the Chief Veterinary Officer for Scotland.

No business and regulatory impact assessment has been prepared for this Order as no impact upon business, charities or voluntary bodies is foreseen.
