Where a person is removed under paragraph 4(1) of schedule 7 to the 2001 Act before the appointed day, on and after that day—

a

paragraph 4(5) of schedule 7 to the 2001 Act is to continue to have effect in relation to the removal; and

b

the removal, and anything done by or in relation to the Scottish Ministers in relation to the removal before the appointed day (including anything done in respect of an appeal brought, but not determined, before that day), is to be treated as having been done by or in relation to the Regulator.

Where, before the appointed day, the Scottish Ministers have given a notice under paragraph 4(3) of schedule 7 to the 2001 Act but have not yet removed the person to whom the notice relates, the notice is, on and after that day, to be treated as a notice given by the Regulator under section 60(2) of the 2010 Act of its intention to remove the person under section 60(1) of the 2010 Act.
