The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 28I(1), (4) and (9) of the Education (Scotland) Act 1980(1) and all other powers enabling them to do so.
1980 c.44 (“the 1980 Act”). Section 28I was inserted by section 17 of the Education (Schools) Act 1992 (c.38). Section 135(1) of the 1980 Act sets out the definition of “prescribed” relevant to the exercise of the statutory powers under which these Regulations are made. The functions of the Secretary of State under the 1980 Act were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c.46).
