The Budget (Scotland) Act 2010 Amendment Order 2011

Coming into force in accordance with article 1

The Scottish Ministers make the following Order in exercise of the powers conferred by section 7(1) of the Budget (Scotland) Act 2010(1) and all other powers enabling them to do so.

In accordance with section 7(2) of that Act, a draft of this Order has been laid before and approved by resolution of the Scottish Parliament.

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Budget (Scotland) Act 2010 Amendment Order 2011 and comes into force on the day after the day on which it is made.

(2) In this Order, “the 2010 Act” means the Budget (Scotland) Act 2010.

Amendment of section 3 of the 2010 Act

2.—(1) Section 3 of the 2010 Act (overall cash authorisations) is amended in accordance with paragraphs (2) to (5).

(2) In paragraph (a) (in relation to the Scottish Administration), for “£31,800,947,000” substitute “£31,218,013,000”.

(3) In paragraph (b) (in relation to the Forestry Commissioners), for “£79,946,000” substitute “£77,569,000”.

(4) In paragraph (c) (in relation to the Foods Standards Agency), for “£11,015,000” substitute “£10,225,000”.

(5) In paragraph (d) (in relation to the Scottish Parliamentary Corporate Body), for “£78,721,000” substitute “£78,774,000”.

Amendment of schedule 1 to the 2010 Act

3.—(1) Schedule 1 to the 2010 Act (the Scottish Administration) is amended in accordance with paragraphs (2) to (4).

(2) In column 1 (purposes)—

(a)in the first purpose, after “other bodies and organisations;” insert “protocol and UK relations;”;

(b)in the fourth purpose, after “Scottish Children’s Reporter Administration” insert “, Children’s Hearings Scotland, Scottish Education Quality and Improvement Agency”;

(c)in the fifth purpose—

(i)before “antisocial behaviour” insert “community safety and”;

(ii)for “the Mental Health Tribunal for Scotland” substitute “the Scottish Tribunal Service”;

(iii)after “administration of justice;” insert “residential accommodation for children;”;

(iv)omit “Protocol and UK Relations;”; and

(d)in the sixth purpose—

(2) In column 2 (amount of resources other than accruing resources)—

(a)in relation to the first purpose, for “£80,046,000” substitute “77,669,000”; and

(b)in relation to the second purpose, for “11,115,000” substitute “10,325,000”.

Amendment of schedule 3 to the 2010 Act

5.—(1) Schedule 3 to the 2010 Act (borrowing by certain statutory bodies) is amended in accordance with paragraph (2).

(2) In column 2 (amount), in relation to the fourth enactment, for “198,000,000” substitute “161,500,000”.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Budget (Scotland) Act 2010 (“the 2010 Act”).

This Order amends the 2010 Act so as to—

(a)alter the overall cash authorisations in relation to the Scottish Administration, the Forestry Commissioners, the Food Standards Agency and the Scottish Parliamentary Corporate Body in section 3 of the 2010 Act (article 2);

(b)alter the first, fourth, fifth and sixth purposes for which resources may be used in accordance with section 1 of, and schedule 1 to, the 2010 Act (article 3(2));

(c)alter the amount of resources other than accruing resources that may be used for all of the purposes set out in schedule 1 to the 2010 Act and the total of amounts of resources for all of the purposes (article 3(3));

(d)alter the amount of accruing resources in respect of certain of the purposes set out in schedule 1 to the 2010 Act and the total of amounts of resources for all of the purposes (article 3(4));

(e)alter the amount of resources other than accruing resources of direct-funded bodies in schedule 2 to the 2010 Act in relation to the first and second purposes (article 4(2)); and

(f)alter the amount of borrowing by certain statutory bodies in schedule 3 to the 2010 Act in relation to the fourth enactment (article 5(2)).
