The Additional Support Needs Tribunals for Scotland (Disability Claims Procedure) Rules 2011

EXPLANATORY NOTE

(This note is not part of the Rules)

The Equality Act 2010 (“the 2010 Act”) extended the jurisdiction of the Additional Support Needs Tribunals for Scotland (“the ASNTS”) to include claims made under Chapter 1 of Part 6 of the 2010 Act. The ASNTS was created under section 17 of, and Schedule 1 to, the Education (Additional Support for Learning) (Scotland) Act 2004 (“the 2004 Act”). These Rules prescribe the practice and procedure to be followed as regards such claims. The Rules are similar to the Additional Support Needs Tribunals for Scotland (Practice and Procedure) Rules 2006 (“the 2006 Rules”) which govern practice and procedure before the ASNTS in proceedings under the 2004 Act but contain amendments appropriate for the new jurisdiction.

Part 2 contains rules about the start of proceedings before the Tribunals.

Part 3 contains rules about the management powers of the Tribunals.

Part 4 contains rules in relation to evidence for claims to the Tribunals.

Part 5 contains rules about hearings before, and decisions of, the Tribunals.

Part 6 contains miscellaneous and general provisions which apply to proceedings before the Tribunals.
