The Control of Salmonella in Turkey Flocks (Scotland) Order 2009

Made

24th November 2009

Coming into force

1st January 2010

The Scottish Ministers make the following Order in exercise of the powers conferred by sections 1 and 8(1) of the Animal Health Act 1981(1) and paragraph 1A of Schedule 2 to the European Communities Act 1972(2) and all other powers enabling them to do so.

This Order makes provision for a purpose mentioned in section 2(2) of the European Communities Act 1972(3) and it appears to the Scottish Ministers that it is expedient for the references in this Order to Community instruments to be references to those instruments as amended from time to time.

The functions conferred under the 1981 Act on “the Ministers” (as defined in section 86 of that Act) are now exercisable by the Scottish Ministers; they were transferred, so far as within devolved competence, by virtue of section 53 of the Scotland Act 1998 (c.46) (“1998 Act”).

(2)

1972 c.68 (“1972 Act”). Paragraph 1A of Schedule 2 was inserted by section 28 of the Legislative and Regulatory Reform Act 2006 (c.51) (“2006 Act”).

(3)

Section 2(2) was amended by paragraph 15(3) of Schedule 8 to the 1998 Act and section 27(1) of the 2006 Act. The function conferred upon the Minister of the Crown under this section, insofar as within devolved competence, was transferred to the Scottish Ministers by virtue of section 53 of the 1998 Act.
