The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 2(2) of the European Communities Act 1972(1) and all other powers enabling them to do so.

Citation and commencement

1.  These Regulations may be cited as the Sheep and Goats (Identification and Traceability) (Scotland) Revocation Regulations 2009 and come into force on 31st December 2009.

Revocations and savings

2.—(1) The enactments specified in Column 1 of the Schedule are revoked.

(2) The enactments specified in Column 1 of the Schedule continue to have effect in relation to anything done, anything begun or any right or liability acquired under or by virtue of any provision of those enactments prior to these Regulations coming into force.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations revoke the Sheep and Goats (Identification and Traceability) (Scotland) Regulations 2006 (“the principal Regulations”) and those instruments amending the principal Regulations.

The principal Regulations are replaced by the Sheep and Goats (Records, Identification and Movement) Order 2009 (S.S.I. 2009/414) which makes provision for the administration and enforcement of Council Regulation (EC) No. 21/2004 (O.J. No. L 5, 9.1.2004, p.8) establishing a system for the identification and registration of ovine and caprine animals and amending Regulation (EC) No. 1782/2003 (O.J. No. L 94, 31.3.2004, p.70) and Directives 92/102/EEC (O.J. No. L 355, 5.12.1992, p.32) and 64/432/EEC (O.J. No. L 121, 29.7.1964, p.1977).

1972 c.68 (“1972 Act”). Section 2(2) was amended by the Scotland Act 1998 (c.46), Schedule 8, paragraph 15(3) and the Legislative and Regulatory Reform Act 2006 (c.51), section 27. The functions conferred upon the Minister of the Crown under section 2(2) of the 1972 Act, insofar as within devolved competence, were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998.
