The Private Landlord Registration (Modification) (Scotland) Order 2009

Coming into force
The Scottish Ministers make the following Order in exercise of the powers conferred by sections 83(7) and 141(2) of the Antisocial Behaviour etc. (Scotland) Act 20041 and all other powers enabling them to do so.
In accordance with section 141(4) of that Act, a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament:
Citation and commencement1
This Order may be cited as the Private Landlord Registration (Modification) (Scotland) Order 2009 and shall come into force on 12th February 2009.
Modification of The Antisocial Behaviour etc. (Scotland) Act 20042
Section 83 of the Antisocial Behaviour etc. (Scotland) Act 2004 (application by landlords for registration) is modified as follows–
a
omit “or” which follows subsection (6)(k); and
b
after subsection (6)(l) insert–
or
m
the house is owned by a person acting as an insolvency practitioner within the meaning of section 388 of the Insolvency Act 19862 and has been so owned by that person for a period not exceeding six months.
