The Scottish Ministers make the following Order in exercise of the powers conferred by section 58(1) and (2) of the Planning etc. (Scotland) Act 2006(1) and all other powers enabling them to do so.

Citation and commencement

1.  This Order may be cited as the Planning etc. (Scotland) Act 2006 (Development Planning) (Saving, Transitional and Consequential Provisions) Amendment Order 2009 and comes into force on 27th February 2009.

Amendment of the Planning etc. (Scotland) Act 2006 (Development Planning) (Saving, Transitional and Consequential Provisions) Order 2008

2.—(1) The Planning etc. (Scotland) Act 2006 (Development Planning) (Saving, Transitional and Consequential Provisions) Order 2008(2) is amended in accordance with paragraph (2).

(2) In article 1(2), in the definition of “the 1994 Regulations” for “the Conservation (National Habitats &c.) Regulation 1994” substitute “the Conservation (Natural Habitats, &c.) Regulations 1994”.

Explanatory Note

(This note is not part of the Order)

This Order amends the Planning etc. (Scotland) Act 2006 (Development Planning) (Saving, Transitional and Consequential Provisions) Order 2008 (“the 2008 Order”). Article 2 corrects the definition of the “the 1994 Regulations” in article 1(2) of the 2008 Order.
