The Public Appointments and Public Bodies etc. (Scotland) Act 2003 (Amendment of Specified Authorities) Order 2008

Coming into force

The Scottish Ministers make the following Order in exercise of the powers conferred by section 3(2)(a) of the Public Appointments and Public Bodies etc. (Scotland) Act 20031 and all other powers enabling them to do so.

In accordance with section 18(4) of that Act, a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament.

Citation and commencement1

This Order may be cited as the Public Appointments and Public Bodies etc. (Scotland) Act 2003 (Amendment of Specified Authorities) Order 2008 and comes into force on the day after the day on which it is made.

Amendment of the list of specified authorities2

Schedule 2 to the Public Appointments and Public Bodies etc. (Scotland) Act 2003 (the specified authorities)2 is amended in accordance with the following paragraphs.

In the listing of the specified authorities, under the heading “Executive bodies”–

a

insert, at the appropriate places–

i

“Quality Meat Scotland”; and

ii

“The Skills Development Scotland Co. Limited”;

b

at the end of “any National Park authority” insert “(except in respect of nominated members, as defined in paragraph 3(7) of schedule 1 to the National Parks (Scotland) Act 20003)”; and

c

omit “Scottish Hospital Endowments Research Trust”.

In that listing, under the heading “Advisory bodies”–

a

insert, at the appropriate place, “Scottish Local Authorities Remuneration Committee”; and

b

omit “Scottish Advisory Committee on the Medical Workforce”.

In that listing, omit–

a

the heading “Nationalised bodies”; and

b

the following entries under that heading–

i

“Caledonian Maritime Assets Ltd”;

ii

“David MacBrayne Ltd”; and

iii

“Highlands and Islands Airports Ltd”.

In that listing, under the heading “Public corporations” insert, at the appropriate places–

a

“Caledonian Maritime Assets Ltd”;

b

“David MacBrayne Ltd”; and

In that listing, under the heading “National Health Service bodies” insert, at the appropriate place, “Common Services Agency for the Scottish Health Service”.

This Order amends schedule 2 to the Public Appointments and Public Bodies etc. (Scotland) Act 2003 (“the Act”), which lists the specified authorities to which the code of practice published by the Commissioner for Public Appointments in Scotland applies, in the following manner.

Article 2(2)(a)(i) and (ii) and (3)(a) insert the following new bodies which have been established as specified authorities under the appropriate headings: Quality Meat Scotland, Skills Development Scotland and Scottish Local Authorities Remuneration Committee.

Article 2(2)(b) amends the entry for “any National Park authority” by excluding nominated members of the Board of a National Park authority from the remit of the Commissioner for Public Appointments in Scotland. A nominated member is defined in the National Parks (Scotland) Act 2000 to mean a member appointed on the nomination of a local authority.

Article 2(2)(c) and (3)(b) removes the Scottish Hospital Endowments Research Trust and the Scottish Advisory Committee on the Medical Workforce because these bodies have been disbanded.

Article 2(4)(a) removes the “Nationalised bodies” heading, as this term is no longer needed, and article 2(4)(b) and (5) have the effect of moving the bodies listed under that heading (Caledonian Maritime Assets Ltd, David MacBrayne Ltd and Highlands and Islands Airports Ltd) to under the heading of “Public corporations”.

Article 2(6) inserts the Common Services Agency for the Scottish Health Service under the “National Health Services bodies” heading.
