The Scottish Ministers make the following Order in exercise of the powers conferred by section 58(1) of the Planning etc. (Scotland) Act 2006(1) and all other powers enabling them to do so.

Citation and commencement

1.  This Order may be cited as the Planning etc. (Scotland) Act 2006 (Development Planning) (Saving Provisions) Order 2008 and comes into force on 19th May 2008.

Saving provision

2.  Notwithstanding the commencement of section 2 of the Planning etc. (Scotland) Act 2006 for certain purposes by the Planning etc. (Scotland) Act 2006 (Commencement No. 3) Order 2008(2) the provisions of Part 2 of the Town and Country Planning (Scotland) Act 1997(3) shall continue in full force and effect.

Explanatory Note

(This note is not part of the Order)

This Order preserves Part 2 of the Town and Country Planning (Scotland) Act 1997 (“the 1997 Act”) in full force and effect notwithstanding the commencement for certain purposes of section 2 of the Planning etc. (Scotland) Act 2006 (“the 2006 Act”). Section 2 of the 2006 Act substitutes a new Part 2 for Part 2 of the 1997 Act.
