The Scottish Ministers make the following Order in exercise of the powers conferred by sections 44(1) and 60(3) of the Further and Higher Education (Scotland) Act 1992(1) and section 135(1) of the Education (Scotland) Act 1980(2) and all other powers enabling them to do so.

Citation and commencement

1.  This Order may be cited as the Designation of Institutions of Higher Education (The Scottish Agricultural College) (Scotland) Order 2008 and comes into force on 1st June 2008.

Designation of The Scottish Agricultural College

2.—(1) The Scottish Agricultural College(3) is designated as an institution providing higher education for the purposes of Part II of the Further and Higher Education (Scotland) Act 1992.

(2) The designation of The Scottish Agricultural College by paragraph (1) shall remain in effect notwithstanding any change of name of that institution.

Revocation of Regulations

3.  The Central Institutions (Recognition) (Scotland) (No. 2) Regulations 1990(4) are revoked.

Explanatory Note

(This note is not part of the Order)

This Order designates The Scottish Agricultural College as an institution of higher education for the purpose of Part II of the Further and Higher Education (Scotland) Act 1992. It also removes the recognition of The Scottish Agricultural College as a central institution for the purpose of section 135(1) of the Education (Scotland) Act 1980 by revoking the Central Institutions (Recognition) (Scotland) (No. 2) Regulations 1990 (S.I. 1990/2386).

Designation of The Scottish Agricultural College as an institution of higher education has been granted by the Scottish Ministers following a designation audit by the UK Universities' Quality Assurance Agency for Higher Education based on a set of criteria in relation to quality set out by the Scottish Government. The audit found that The Scottish Agricultural College satisfied all the criteria.

1992 (c. 37). Section 44(1) was amended by schedule 3, paragraph 6(c) of the Further and Higher Education (Scotland) Act 2005 (asp 6). The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46) (“the Scotland Act”).

1980 (c. 44). Section 135(1) contains a definition of “central institution” which includes the statutory powers under which the Central Institutions (Recognition) (Scotland) (No. 2) Regulations 1990 were made. The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act.
