The Transport (Scotland) Act 2005 (Commencement No. 3) Order 2007

The Scottish Ministers make the following Order in exercise of the powers conferred by section 54(2) of the Transport (Scotland) Act 2005(1).

Citation and interpretation

1.  This Order may be cited as the Transport (Scotland) Act 2005 (Commencement No. 3) Order 2007.

Appointed day

2.  The appointed day for the coming into force of sections 25 (enforcement of sections 118 and 119 of the 1991 Act) and 39 (consultation on regulations and codes of practice) of the Transport (Scotland) Act 2005 is 1st October 2007.

Explanatory Note

(This note is not part of the Order)

This Order, at article 2, appoints 1st October 2007 as the day for the coming into force of sections 25 (enforcement of sections 118 and 119 of the 1991 Act) and section 39 (consultation on regulations and codes of practice) of the Transport (Scotland) Act 2005 (“the Act”). Section 25 inserts a new section 119A into the New Roads and Street Works Act 1991. Section 39 inserts a new section 163A into that Act.

The Act received Royal Assent on 5th August 2005. Sections 52 and 54 came into force on Royal Assent.

The provisions of the Act remaining to be commenced after the making of this Order are sections 18 to 24, and 26 to 38, which all relate to road works.
