Pension for child where no survivor’s pension paid10

Where–

a

no person is entitled to a pension under rule 1 of this Part as a survivor of the deceased; and

b

a child of the deceased is eligible for a child’s pension under rule 6 of this Part,

the authority shall pay to the child, for so long as that child is an eligible child, the amount that would have been paid by way of survivor’s pension under rule 2 of this Part if, in paragraph (1) of that rule, the words “Subject to rule 3” had been omitted.

Where there is more than one eligible child, the amount referred to in paragraph (1) shall be divided equally between the eligible children; but–

a

a child’s share shall cease to be paid as soon as that child’s pension ceases to be payable; and

b

the share to which the child would otherwise have been entitled shall be distributed equally among any remaining eligible children.
