Influenza virus of avian origin is hereby specified for the purposes of section 32(2) of the Act.

The Scottish Ministers must ensure that pigs to be killed under section 32 of the Act are–
a
killed as soon as possible, in accordance with a veterinary inspector’s instructions;
b
transported in accordance with a veterinary inspector’s instructions (if they are moved off the premises for slaughter).

The Scottish Ministers may also require the killing of other mammals infected with influenza virus of avian origin which they consider to be a serious threat to animal or human health.
