The Maximum Number of Part-Time Sheriffs (Scotland) Order 2006

Coming into force in accordance with article 1 9

The Scottish Ministers, in exercise of the powers conferred by section 11A(5) of the Sheriff Courts (Scotland) Act 1971(1), and of all other powers enabling them in that behalf, hereby make the following Order, a draft of which has, in accordance with section 11D(2) of the Act, been laid before, and approved by a resolution of the Scottish Parliament:

Citation and commencement

1.  This Order may be cited as the Maximum Number of Part-Time Sheriffs (Scotland) Order 2006 and shall come into force on the day after the day on which it is made.

Increase in Maximum Number of Part-Time Sheriffs

2.  In section 11A(5) of the Sheriff Courts (Scotland) Act 1971 (which provides that the number of persons holding appointments as part-time sheriffs shall not at any one time exceed 60) for the number “60” there is hereby fixed in substitution the number “80”.

Explanatory Note

(This note is not part of the Order)

This Order amends section 11A(5) of the Sheriff Courts (Scotland) Act 1971 so as to raise the maximum number of part-time sheriffs at any one time from 60 to 80.
