Citation and commencement

1.  This Order may be cited as the Education (Listed Bodies) (Scotland) Amendment (No. 2) Order 2005 and shall come into force on 1st December 2005.

Amendments to the Education (Listed Bodies) (Scotland) Order 2004

2.  The Education (Listed Bodies) (Scotland) Order 2004(2) is amended as follows.

3.  In Part I of the Schedule–

(a)omit–

(i)“Central School of Speech and Drama”;

(ii)“Edge Hill College of Higher Education”;

(iii)“Kent Institute of Art and Design”;

(iv)“Laban Centre, London”;

(v)“Southampton Institute”;

(vi)“Surrey Institute of Art and Design University College, The”; and

(vii)“York St John College”;

(b)for “Trinity College of Music”, substitute “Trinity Laban”.

4.  In Part II of the Schedule, in the entry relating to “UNIVERSITY OF WALES”, omit–

(a)“University of Wales, Cardiff”; and

(b)“University of Wales College of Medicine”.

Explanatory Note

(This note is not part of the Order)

The Education (Listed Bodies) (Scotland) Order 2004 lists the name of every body which is not a “recognised body” within section 216(4) of the Education Reform Act 1988, but which appears to the Scottish Ministers either:

(a)to provide any course which is in preparation for a degree to be granted by such a recognised body and is approved by or on behalf of that body; or

(b)to be a constituent college, school, hall or other institution of a university which is such a recognised body.

“Recognised bodies” are universities, colleges or other bodies which are authorised by Royal Charter, or by or under Act of Parliament, to grant degrees and other bodies for the time being permitted by those bodies to act on their behalf in the granting of degrees.

This Order amends the Education (Listed Bodies) (Scotland) Order 2004 (S.S.I. 2004/539) to remove Central School of Speech and Drama, Edge Hill College of Higher Education, Kent Institute of Art and Design, Laban Centre, London, Southampton Institute, The Surrey Institute of Art and Design University College and York St John College from the list of bodies appearing to the Scottish Ministers to fall within (a) above. It also removes University of Wales, Cardiff and University of Wales, College of Medicine from the list of bodies appearing to the Scottish Ministers to fall within (b) above. It also reflects the fact that Trinity College of Music has changed its name to Trinity Laban.

A Regulatory Impact Assessment has not been produced for this instrument as it has no impact on the costs of business or charities.
