Where, after the appointed day, the Scottish Ministers, in a case to which paragraph 1 of the schedule to this Order applies, refuse to confirm the education authority’s decision, the child or young person shall be taken to have been a recorded child or, as the case may be, young person, immediately before the commencement date, for the purpose of section 30(1)(b) of the 2004 Act.
