The Further and Higher Education (Scotland) Act 2005 (Commencement) Order 2005

The Scottish Ministers, in exercise of the powers conferred on them by sections 36(2) and (3) of the Further and Higher Education (Scotland) Act 2005(1) hereby make the following Order:

Citation

1.  This Order may be cited as the Further and Higher Education (Scotland) Act 2005 (Commencement) Order 2005.

Appointed day

2.—(1) The day appointed for the coming into force of all of the provisions of the Further and Higher Education (Scotland) Act 2005, with the exception of section 2, is 3rd October 2005.

(2) The day appointed for the coming into force of section 2 of the Further and Higher Education (Scotland) Act 2005 is 8th September 2005.

Explanatory Note

(This note is not part of the Order)

This Order brings into force on 3rd October 2005 all the provisions of the Further and Higher Education (Scotland) Act 2005 (the Act), with the exception of section 2.

This Order also brings into force on 8th September 2005 section 2 of the Further and Higher Education (Scotland) Act 2005. Section 2 permits an Order to be laid dissolving the Scottish Further Education Funding Council and the Scottish Higher Education Funding Council.

Sections 33 to 36 came into force on Royal Assent of the Act, 1st June 2005, by virtue of paragraph 2 of Schedule 1 to the Scotland Act 1998 (Transitory and Transitional Provisions) (Publication and Interpretation etc. of Acts of the Scottish Parliament) Order 1999.
