The Scottish Ministers, in exercise of the powers conferred by section 233(6) of the Mental Health (Care and Treatment) (Scotland) Act 2003(1) and of all other powers enabling them in that behalf, hereby make the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Mental Health (Fee Payable to Designated Medical Practitioners) (Scotland) (No. 2) Regulations 2005 and shall come into force on 5th October 2005.

Prescribed Fee

2.  The fee prescribed for the purposes of section 233(6) of the Mental Health (Care and Treatment) (Scotland) Act 2003 (fee payable to designated medical practitioners for or in connection with the discharge of the functions conferred on them by virtue of Part 16 of that Act) is £141.56.

Revocation

3.  The Mental Health (Fee Payable to Designated Medical Practitioners) (Scotland) Regulations 2005(2) are revoked.

Explanatory Note

(This note is not part of the Regulations)

These Regulations prescribe the fee payable to designated medical practitioners for discharge of their functions under Part 16 of the Mental Health (Care and Treatment) (Scotland) Act 2003 (asp 13). The Regulations set the fee at £141.56. They replace the Mental Health (Fee Payable to Designated Medical Practitioners) (Scotland) Regulations 2005.
