The Seed Potatoes (Scotland) Amendment Regulations 2005

Interpretation

2.  In these Regulations–

• “classified”, for the purposes of regulation 23, means–

  (a)

  in the case of seed potatoes produced in Scotland the class in which the seed potatoes were placed as disclosed on a certificate of classification issued prior to 1st January 2005 under the principal Regulations; and

  (b)

  in the case of seed potatoes produced outside Scotland, the class specified on a label or in a document issued prior to 1st January 2005 by a relevant authority, being a label attached to or a document contained in the package or container in which the seed potatoes are moved into Scotland;

• “the principal Regulations” means the Seed Potatoes (Scotland) Regulations 2000(1);

• “relevant authority” means the authority in the country or place where seed potatoes are produced which is concerned with the classification of seed potatoes in that country or place for the purposes of Council Directive 2002/56/EC”(2) and

• “VTSC” means basic seed potatoes classified in the Virus Tested Stem Cutting class.
