2.—(1) Subject to paragraph (2), each of the persons listed in the Schedule to this Order are designated as a relevant regulatory authority for the purposes of the Nature Conservation (Scotland) Act 2004.
(2) The designation of a local authority under paragraph (1) does not extend to its functions of granting planning permissions on an application under Part III of the Town and Country Planning (Scotland) Act 1997(1).
